本服務條款係為提供實習職缺的企業或政府機關(以下合稱『企業及機關會員』)與全球專業實習聯盟平臺(以下簡稱『本計畫』)之間的合作同意事項。本服務條款得隨時修訂並公告於平台上,修訂後之內容自公告時起生效。
一、刊登服務
(一)企業及機關會員應提供真實之身分資格證明(如:企業登記或設立之證明、最新之公司變更登記事項卡)或其他經本計畫要求提出之必要證明文件,以確認企業及機關會員之身分或資格之真確性。本計畫有權就企業及機關會員所提供之資料進行建檔,並於主管機關或司法機關依法查詢或調查時提供之。
(二)企業及機關會員刊登之內容,應符合法令規定要求;其所提供的廣告素材、廣告內容或廣告所連結的網站上,不得包含任何違反中華民國法令、公序良俗或侵害他人權利的情形。企業及機關會員並須保證提供的訊息是真實及完整之資料。企業及機關會員刊登的內容或圖片有侵犯他人權利之內容與字眼等情況時(如著作權、專利權、商標權、營業秘密或其它權利或有影射毒品、賭博、誹謗、色情等情事),本計畫於發現時得移除之。
(三)企業及機關會員應自行更新維護實習職缺內容,以及企業簡介的文字、圖檔資料。所有上載、傳送、輸入或提供於平台之任何資料,企業及機關會員同意授權本計畫得管理利用,本計畫可修改、重製、翻譯、散布、發行及公開播送、公開發表、公開傳輸、公開上映該等資料。
(四)企業及機關會員不得假借他人名義或接受他人請託為虛偽或不實之刊登。如有違反,本計畫於發現時得立即終止刊登服務,並移除刊登之內容。企業及機關會員同意且瞭解於平臺實習職缺廣告刊登期間內,企業及機關會員(含所屬人員)所知悉或持有之參與實習者履歷資料及本計畫企業及機關會員專屬查詢密碼,企業及機關會員僅能供作自身徵才用途之使用,不得將該履歷資料或本計畫企業及機關會員專屬查詢密碼,以任何方式或管道公開該資料,或將之轉作為非自身徵才用途之其他商業或非商業之利用,亦不得提供予關係企業或他人利用。企業及機關會員企業及機關會員違反本項約定時,應自負一切相關法律責任,若逕自刊登而致使本計畫被調查、追訴、索賠或處以行政罰鍰時,企業及機關會員應就本計畫所受損害負擔全部賠償責任(包括但不限於律師費)。
(五)本計畫僅提供實習職缺廣告之刊登,不保證企業及機關會員於刊登期間內,有一定數量之主動應徵實習者或滿足所有刊登實習職缺,亦不為任何一位參與實習者提供任何形式之保證,企業及機關會員仍須依面試程序自行篩選及過濾。企業及機關會員如與實習者發生任何爭議,不論面試或錄用前後,均應由企業及機關會員與實習者雙方自行協商或依循法律途徑解決。
(六)刊登期間,本計畫保留審核刊登權限。本計畫免費提供人才搜尋、履歷收件紀錄、面試管理及學生實習報告等服務。附屬服務內容並非固定,本計畫保留隨時視情況調整之權利。
二、參與實習者之保護
(一)企業及機關會員提出實習職缺,須注意符合就業服務法及其他法令規定。
(二)企業及機關會員應保證單位基本資料及各項實習職缺登錄均屬真實,並於刊登前詳細核對,如有錯誤自行負責。
(三)企業及機關會員應確實遵守下列事項:

三、智慧財產權
企業及機關會員同意且瞭解本計畫上所有內容,包含文字、圖形、影音、程式、畫面安排及資料編輯等,其著作權、專利權、商標及其他智慧財產權,均屬於本計畫所有,任何人於未經合法授權前,不得擅自以任何形式重製、改作、編輯、散布、公開傳播或其他非法使用,如有違反本計畫將依法追訴並請求相關之損害賠償責任。
四、其他約定事項
(一)本計畫保有調整企業及機關會員實習職缺出現於參與實習者搜尋結果之版位及順序之權限,刊登期間內,企業及機關會員不得以任何方式或理由要求調整,如有違反,本計畫得停止實習職缺之刊登。
(二)企業及機關會員有停業、歇業、撤銷或廢止登記、聲請重整、破產、解散、合併等情形時,本計畫得主動或於企業及機關會員動通知時終止本服務。
(三)企業及機關會員須配合本計畫系統安全管理,提供所需資訊並定時更改帳號密碼。逾期未提供或更改,本計畫得暫停刊登。
貳、個人資料保護
企業及機關會員因使用本計畫之服務功能,可能須提供企業及機關會員所屬人員之個人資料。有關個人資料之保護,本計畫謹依法告知下列事項:
一、本計畫係經由企業及機關會員提供而取得所屬人員之姓名、電話號碼、傳真、電子郵件、工作地址等資料。企業及機關會員提供前述個人資料時,保證已取得本人同意,如未取得本人同意,企業及機關會員應對本計畫所有損害負賠償責任(包括但不限於律師費)。
二、蒐集之個人資料類別為識別類(C001)
三、本計畫將依個人資料保護法及相關法令,基於專業人才招募、聘用,以及產學合作媒合等特定目的之合理關聯範圍內,蒐集、處理及利用企業及機關會員所提供之個人資料。
四、對於前述個人資料得依據個人資料保護法第三條規定行使相關權利,包括查詢、請求閱覽、請求製給複製本、請求補充或更正、請求停止蒐集、處理或利用,以及請求刪除等。有關當事人權利行使之程序,以本計畫公布內容為準。

The following terms of service set forth the agreement between an employer member (the “employer”) and the Global Internship Facilitation of Taiwan platform (the “program”). These terms may be amended at any time, and such amendments are effective immediately upon posting of such amendment on the program’s official web site.
A. Employer member terms of service
1. Posting services
(1) The employer shall provide documents that verify its legal status, such as a business registration certificate, as well as any other supplementary documentation requested by the program for the purpose of confirming identities or qualifications. The program has the right to store and archive all information provided by the employer and share it with the competent authority or judiciary if necessary.
(2) The content posted by the employer must comply with all applicable laws and regulations. All advertising materials, content and web site links shall not break any laws of the Republic of the China, violate public decorum or infringe upon the rights of other people. The employer guarantees that all information it provides is authentic and complete. The program will delete content or images that are in violation of the law (e.g. copyright, patent, trademark and trade secret laws), infringe upon the rights of other people, promote drug use or gambling, contain defamatory language or contain pornographic material.
(3) The employer is responsible for maintaining and updating the content of open internship postings and the text and images in its public profile. The employer authorizes the program to manage and use all information that is uploaded, transmitted, input or provided to the platform by the employer. Such information can be modified, reproduced, distributed, published, publicly broadcasted, publicly displayed, publicly transmitted and publicly exhibited by the program.
(4) The employer is prohibited from posting information on behalf of another party, with or without consent from that party. Violation of this rule will result in immediate termination of posting privileges and removal of content in violation. The employer agrees and understands that all resume information from internship applicants and the associated access code assigned to the employer can only be used for the employer’s own recruitment purposes. Such resume information and access code cannot be made publicly available in any manner, used for commercial or non-commercial purposes unrelated to recruitment, or shared with affiliate companies or third parties. If in violation of this clause, the employer shall be fully liable for any damages, including losses of the program resulting from investigation, criminal prosecution, legal claims, or imposition of administrative fines.
(5) The program only offers a platform for advertising internship positions and does not guarantee a minimum number of applicants for each positon or that each position will be filled. The program does not endorse any of the internship applicants, and the employer is responsible for screening the applicants through interviews. Any dispute between the employer and internship applicant—at any point of the recruitment process or duration of the internship--must be resolved by negotiations between the two parties or through legal proceedings.
(6) For the duration of each internship posting, the program reserves the right to approve the content of the posting. The program provides free services that include talent searching, applicant resume storage, interview management and student internship report management. The type of services provided are not fixed, and the program reserves the right to modify the existing services at any time.
2. Protection of internship participants
(1) All internship positions posted by the employer must comply with the Employment Service Act and other applicable laws and regulations.
(2) The employer shall guarantee all information in its basic profile and internship postings are true. Every internship position must be reviewed for authenticity before posting, and the employer is fully responsible for any errors.
(3) The employer shall adhere to the following rules:
a. The intern shall not be required to provide proof of financial ability, pay a deposit, supply bank account information or provide any personal information that is not needed for employment purposes. The intern shall not be required to purchase goods, services, courses, or memberships, nor shall the intern be forced to enter into agreements or pay fees that are unrelated to his or her employment.
b. The employer shall not send any information via telephone or email to the intern that does not match the stated interests or preferences of the intern or is unrelated to the internship.
(4) The employer agrees and understands that, for the purpose of protecting the privacy and rights of our interns, the program may suspend all or part of the platform’s services if any of the following violations occur:
a. The internship involves multi-level marketing or insurance sales, regardless of whether such activity is legally licensed or approved.
b. The intern files a complaint with the program or applicable regulatory body against the employer for one of the following acts: soliciting the intern to purchase goods, services, courses, or memberships; forcing the intern to enter into agreements or pay fees that are not related to the internship.
c. Irregularities exist with the employer’s internship postings, such as internship duties that are not consistent with the stated business of the employer or the number of postings are not in line with the scale of the employer’s business.
d. The member account and password was not adequately protected or was shared with another party.
e. If a complaint is filed against an employer who does not fulfill its internship-related obligations (including, but not limited to, arbitrarily cancelling interviews or internships, and not paying internship scholarships), and such complaint is confirmed to be true after investigation, the program will post the infraction on its official web site where all members can see.
f. In order to monitor the quality of internships offered on the platform, an employer must complete a questionnaire after every interview or internship.
3. Intellectual property rights
The employer agrees and understands that all content of the program, including text, images, audio, video, programming code, visual design and data organization, is the exclusive property of the program and protected under copyright, patent, trademark and other intellectual property laws. This content cannot be reproduced, modified, revised, distributed, displayed, or used illicitly in any way without prior authorization. The program will seek compensation in court for damages resulting from infringement of intellectual property rights.
4. Other agreed upon terms
(1) The program reserves the right to alter the order in which an employer’s internship posting appears in search results. The employer cannot request to have this order changed for any reason. If in violation, the program may suspend posting privileges of the employer.
(2) If the employer is ending or suspending its business, revoking or cancelling its business registration, or filing for reorganization, bankruptcy, dissolution, or merger, the program will terminate all services provided.
(3) In accordance with the program’s system security protocols, the employer shall provide the necessary information when requested and periodically change its password. Failure to follow these security requirements may result in suspension of posting privileges.
B. Protection of personal information
When using the program’s services, the employer may have to provide personal information of its employees. In accordance with applicable laws, the program will disclose the following information pertaining to the protection of personal information:
1. The program will obtain employee information from the employer that include names, phone and fax numbers, emails, and employment addresses. When the employer provides the aforementioned personal information, it guarantees it has already obtained the consent of owners of such information. If consent is not obtained, the employer is fully liable for any damages incurred by the program, including but not limited to legal fees.
2. Types of personal information collected: identification type C001.
3. In accordance with the Personal Data Protection Act and other applicable laws and regulations, the program will collect, process and use personal information provided by the employer for the purpose of talent recruitment and public-private collaboration projects.
4. Owners of the aforementioned personal information have the following rights in accordance with Article 3 of the Personal Data Protection Act: the right to make inquiry of your data, the right to review your data, the right to request a copy of your data, the right to supplement or correct your data, the right to demand the cessation of the collection, processing and use of your data, and the right to erase your data. The program shall set forth the policies and procedures by which the owners can exercise the aforementioned rights.
